Terms and Conditions of Use

Chapter 1 General Rules

Article 1 (Purpose)

These terms and conditions aim at specifying the rights, obligations, and responsibilities of users for the use of internet-related services and other incidental services provided by the website (lotte-autoglobal.net, hereinafter referred to as “Lotte Auto Global”) operated by Lotte Rental Co., Ltd. (hereinafter referred to as the “Company”).

Article 2 (Definitions of Terms)

1. Definitions of terms used in the terms and conditions are as follows.

  1. ① “Lotte Auto Global” refers to an online business place operated by “Lotte Auto Auction Global” to provide information on products or services to users, and the operating method of the business place may be added or changed in the future depending on the circumstances of the Company.
  2. ② “Service” refers to the supply of products and performance of services provided by “Lotte Auto Global”.
  3. ③ “User” refers to a member and a non-member who accesses “Lotte Auto Global” and receives services provided by “Lotte Auto Global” in accordance with these terms and conditions.
  4. ④ “Member” refers to a person who has registered as a member by providing personal information to “Lotte Auto Global”, continuously receives information from “Lotte Auto Global”, and continues to use the services enhanced by “Lotte Auto Global”.
  5. ⑤ “Non-member” refers to a person who uses the services provided by “Lotte Auto Global” without joining as a member.

2. Definitions of terms other than those specified in each item of Paragraph 1 shall follow related laws and regulations and general commercial practices.

Article 3 (Specification and Revision of Terms and Conditions)

1. The Company posts the contents of the terms and conditions on the membership registration process and service screen so that users can easily view them.

2. The terms and conditions come into effect by posting them online on Lotte Auto Global, and members who have agreed to the terms and conditions and signed up for membership are subject to the terms and conditions agreed upon from the time they agree to the terms and conditions. If there is a change in the terms and conditions, the changed terms and conditions will be applied from the time the change takes effect.

3. The Company may amend the terms and conditions to the extent that the amendment does not violate relevant laws such as the “Act on Consumer Protection in Electronic Commerce, etc.”, the “Framework Act on Electronic Documents and Electronic Transactions”, the “Electronic Signature Act”, and the “Framework Act on Consumers”.

4. The terms and conditions can be amended from time to time, and if the Company intends to amend the terms and conditions, the date of application and the revised contents shall be displayed on the initial screen of Lotte Auto Global 14 days prior to the date of application of the amended terms and conditions. In addition, the Company may notify members of them through one of the methods set out below. However, if the contents of the terms and conditions are changed unfavorably to members, it shall be notified with a grace period of at least 30 days in advance.

  3. ③ Written notice or flyer notice
  4. ④ Posting within the Company's branch offices
  5. ⑤ Other methods such as telephone guidance using the contact information provided by members at the time of membership registration

5. When the Company amends the terms and conditions, the amended terms and conditions apply only to contracts concluded after the effective date, and the terms and conditions before the amendment apply to contracts already concluded before that date. However, if a user who has already concluded a contract sends a message to Lotte Auto Global that he/she wishes to be subject to the provisions of the amended terms and conditions within the notice period of the amended terms and conditions and receives the consent of the Company, the provisions of the amended terms and conditions will be applied.

6. If a member does not agree to the changed terms and conditions, the member may stop using the service and terminate the use contract. However, if the member does not raise an objection before the notice period in Paragraph 4, the member is deemed to have agreed to the changed terms and conditions.

7. Matters not stipulated in the terms and conditions and interpretation of the terms and conditions shall be governed by the Consumer Protection Guidelines for Electronic Transactions established by the government and related laws or commercial practices.

Article 4 (Provision and Change of Services)

1. The Company provides the following services:

  1. ① Provision of information related to vehicle sales and export brokerage;
  2. ② Provision of export forwarding and other export-related information that may arise in the process of export brokerage; and
  3. ③ Other services determined by the Company.

2. The Company may change the services in Paragraph 1 or develop a new service and provide it to users.

3. Depending on the conditions necessary to provide the services, there may be restrictions on the services and functions available to users.

Article 5 (Suspension of Services)

1. When natural disaster, war, riot, civil war, enactment/opening and closing of laws and regulations, order/disposition by public authorities, labor dispute, maintenance, replacement or breakdown of information and communication facilities such as computers, or interruption of communication, etc., occur, the Company may temporarily suspend the provision of services.

2. Except in the case of force majeure among the reasons in Paragraph 1, the Company compensates for damages incurred to users or third parties due to the temporary suspension of the provision of services. However, this is not the case if the Company proves that there is no intentional or gross negligence.

Article 6 (Membership Registration)

1. Users apply for membership by entering the member information in the registration form set by the Company through the membership registration procedure performed by accessing Lotte Auto Global and expressing their intention to agree to the terms and conditions.

2. When a user clicks the “I agree” button or the mark of agreement on the screen confirming agreement to the terms and conditions on Lotte Auto Global, it is deemed that the user agrees to the contents of the terms and conditions.

3. A person who wants to become a member must provide all information requested by the Company.

4. A person who wishes to become a member must apply for membership by entering his/her real name and actual information. In the case of falsely entering the real name or other information, or stealing another person's name, the member's rights under the terms and conditions cannot be asserted, and the Company may cancel or terminate the membership contract.

5. The Company registers any user as a member among users who have applied for membership as described in Paragraph 1, unless he/she falls under any of the following items:

  1. ① Within 3 months from the date of withdrawal in the case of withdrawal from membership pursuant to Article 7 (1);
  2. ② If there is a history of loss of membership in accordance with Article 7 (3);
  3. ③ If there is a falsehood, omission, or error in the registration contents; or
  4. ④ If it is judged that registering as a member significantly interferes with the services of the Company.

6. The time of establishment of the membership contract is when the Company's approval reaches the member.

When there is a change in information such as phone number, e-mail, etc., the member must immediately access Lotte Auto Global and modify it online or notify the Company of the change in other ways such as wired or wireless notification. Disadvantages caused by not notifying the change shall be borne by the member.

8. Any member cannot transfer his/her membership to others, or use it for rental or collateral purposes.

9. Any member must manage his/her member information with due diligence as a good manager. The member is responsible for damages caused by negligent management of his/her member information or consent to use it by a third party.

Article 7 (Membership Withdrawal and Loss of Membership, etc.)

1. A member may request withdrawal from Lotte Auto Global at any time, and the Company will immediately process the withdrawal of membership, except in cases where the Company retains member information in accordance with relevant laws and regulations and the consent of the member.

2. If a member falls under any of the following reasons, the Company may restrict or suspend membership:

  1. ① In the case of registering false information when applying for membership under Article 6 (1);
  2. ② If the member does not pay the price of services, etc. purchased using Lotte Auto Global or other debts borne by the member in relation to the use of Lotte Auto Global by the due date;
  3. ③ In the case of threatening the order of electronic transactions, such as interfering with others' use of Lotte Auto Global or stealing the information; or
  4. ④ In the case of using Lotte Auto Global to conduct an act prohibited by laws and regulations and the terms and conditions or contrary to public order and morals.

3. If an act corresponding to each item of Paragraph 2 is repeated twice or more, or if the cause is not corrected within 30 days, the Company may forfeit membership.

4. If the Company forfeits membership, membership registration is cancelled. In this case, the member is notified of this and given an opportunity to give an explanation before the cancellation of membership registration.

Article 8 (Notification to Members)

1. When the Company sends notice to a member, it can be made to the e-mail address submitted by the member to the Company, and the provisions regarding the notification method and the effectiveness of the notification in Article 3 apply mutatis mutandis to individual or overall notification stipulated in each clause of the terms and conditions.

2. In the case of a notification to a large number of unspecified members, the Company may substitute individual notice by posting it on Lotte Auto Global for more than one week. However, individual notice is sent for matters that have a significant impact on the member's transaction.

Article 9 (Establishment of Service Use Contract)

The service use contract is established when the user applies for the use of the services. However, in the following cases, the Company may cancel the service use contract:

  1. ① If there is falsehood, omission, or error in the contents of application for service use; or
  2. ② If the Company judges that the provision of services is significantly impeded due technological reasons.

Article 10 (Personal Information Protection)

1. The Company strives to protect users' personal information in accordance with the relevant laws and regulations. For the protection and use of users' personal information, the relevant laws and regulations and the personal information processing policy notified separately by the Company apply.

2. The Company is not responsible for any information, including personal information of the user, that has been leaked or exposed due to reasons attributable to the user.

3. A user can request to view and correct errors in his/her personal information held by the Company at any time, and the Company will take necessary measures for the request without any delay.

Article 11 (Obligations of the Company)

1. The Company shall not engage in acts prohibited by laws and regulations and the terms and conditions or contrary to good customs or other social order, and shall make every effort to provide services continuously and stably as stipulated in the terms and conditions.

2. The Company shall have a security system to protect users' personal information so that users can use the services safely.

Article 12 (Member's Obligations for ID and Password)

1. A member who wants to use Lotte Auto Global shall register his/her ID and password with Lotte Auto Global as determined by the Company.

2. Any member is responsible for managing his/her ID and password, and shall not disclose his/her ID and password to a third party nor have a third party to use them.

3. If a member recognizes that his/her ID or password has been stolen or used by a third party, the member shall immediately notify the Company of it and follow the Company's instructions.

Article 13 (Obligations of Users)

1. Users shall not engage in the acts stipulated in each of the following items:

  1. ① Registration of false information when applying or changing;
  2. ② Changing or deleting information posted on Lotte Auto Global or Company’s branch offices;
  3. ③ The act of sending, receiving, or posting information (computer programs, etc.) other than those specified by the Company;
  4. ④ Infringement of intellectual property rights such as copyrights of the Company or a third party;
  5. ⑤ Acts that damage the reputation of the Company or a third party or interfere with business;
  6. ⑥ Disclosure or posting of obscene or violent messages, images, voices, or other information that goes against public order and morals on Lotte Auto Global; and
  7. ⑦ Delaying payment for vehicles purchased through Lotte Auto Global.

Article 14 (Relationship between Connection Sites and Connected Sites)

1. When Lotte Auto Global and other internet sites are linked by hyperlinks (eg, hyperlink targets include text, pictures, and videos), the former is called the connection website and the latter is called the connected website.

2. The connection website is not responsible for guarantees for transactions with users made by the service provided by the connected website arbitrarily.

Article 15 (Attribution of Copyright and Restrictions on Use)

1. Copyrights and other intellectual property rights for works created by the Company belong to the Company.

2. Any user shall not use the information obtained by using Lotte Auto Global for commercial purposes by copying, transmitting, publishing, distributing, broadcasting or other methods without prior consent of the Company, or allowing a third party to use it.

Article 16 (Dispute Resolution)

1. The Company establishes and operates a damage compensation processing organization to reflect just opinions or complaints raised by users and compensate for the damage.

2. If there are any complaints or opinions submitted from a user, the Company will prioritize them. However, if prompt processing is difficult, the reason and processing schedule will be notified to the user.

3. In the event of a user's request for relief from an e-commerce dispute between the Company and the user, the Company may follow the mediation of the Fair Trade Commission or the dispute resolution agency commissioned by the Mayor/Do Governor.

Article 17 (Governing Law and Competent Jurisdiction)

1. In case of disputes between the Company and users in relation to the services provided through Lotte Auto Global and the terms and conditions, the Korean laws apply.

2. For litigation related to disputes between the Company and users, the Seoul Central District Court of the Republic of Korea is the competent jurisdiction of the first instance.

Supplementary Rules

These terms and conditions are effective from 21/10/2022.
